Verdalune Terms of Service

These Terms apply to everyone who uses Verdalune, wherever they live. Verdalune is operated by DataNaat. Contact us at info@datanaat.com. By using the app or related services, you agree to these Terms and the Privacy Policy. If you do not agree, do not use Verdalune. You must be 16 or older and legally able to accept these Terms.
1. What Verdalune does
Verdalune helps you find plants, understand their care and keep a private record of your garden. Depending on the available version, it may provide plant guides, reminders, journals, local weather, frost and planting guidance, optional photo identification, notifications and paid features. Features may vary by device, location, data availability and subscription. Describing a feature here does not mean it is active in your installed version. Verdalune has no public user profiles or social feed.
Some functions require an account and a selected garden location. You may enter a place manually rather than allow GPS. You are responsible for keeping your sign-in method secure and providing accurate account information. Do not access another person’s account, impersonate others or sell or transfer your account without permission.
2. Your garden content
You keep the rights you have in the garden names, photographs, plant records, notes and other content you provide. You allow DataNaat to store, format, synchronize and process it only to deliver and secure Verdalune, follow your instructions, comply with law and enforce these Terms. Ordinary garden content is private to your account and is not sold or used for advertising. Do not enter another person’s sensitive data, passwords or card numbers in free-text fields.
A personal photograph saved with a garden record is different from a photograph you voluntarily send for identification. The latter has additional terms in Section 3.
3. Optional photo identification
When photo identification or visible plant-health analysis is available, you may use it only after a separate notice and affirmative choice. Verdalune sends the photograph you choose, the type of analysis and, when relevant, an approximate location cell to an external plant-identification AI provider. It does not send that provider your Verdalune account ID, email, display name or exact coordinate from us. The image is reconstructed without its original EXIF metadata before upload. You may decline and search by plant name instead.
You keep ownership rights in the photograph, but you grant DataNaat a non-exclusive, worldwide, royalty-free license to transmit and technically process it for the requested scan and to grant the rights required by the provider’s standard terms. Those terms require a non-exclusive, unlimited and irrevocable license to the provider. It may retain or modify the image, use it commercially and to improve AI, include it in results for other customers and share it under Creative Commons Attribution-ShareAlike 4.0 or a later version. Submit only a photograph you own or are authorized to license, and avoid people, addresses, documents or other identifying details.
Withdrawing scan consent stops future uploads but may not revoke the provider’s previously granted license or recall prior copies or model improvements. Six-month API availability is not a promise that every copy or derivative is erased. Mandatory privacy rights remain available as explained in the Privacy Policy.
Identification and care suggestions can be wrong. You choose whether to accept a suggested plant; an illustration is not proof of identity. Do not rely on Verdalune to decide food safety, toxicity, medical or veterinary treatment, pesticide use, or emergencies.
4. Purchases and subscriptions
If paid features are offered, the price, period, trial, limits and taxes displayed by the relevant app store when you purchase control that transaction. A subscription may renew automatically until you cancel through that store under its displayed rules. Uninstalling Verdalune or deleting your account does not cancel store billing. Paid access may require a connection and verification of your entitlement. No page on this website promises unlimited scans, credits or a particular price. Mandatory refund and consumer rights remain intact.
5. Acceptable use and availability
Use Verdalune lawfully and respect other people’s rights. Do not breach security, access another account, send malicious material, automate abusive traffic, scrape the catalog to build a competing service, misuse credits or purchases, resell access or remove required attribution. We may restrict access when reasonably necessary for abuse, security, fraud, law or a material breach, with notice when appropriate.
Weather, frost, planting dates, soil conditions, moon information, plant identification and care guidance are estimates or general information. Check actual local conditions and product labels. Verdalune does not replace professional advice. We may change or retire features for security, compatibility, law or design and will provide any notice or remedy required for a material change to paid service. We cannot guarantee continuous or error-free availability.
Some information, images and components have third-party or open licenses. The relevant credit and license information must be preserved where required. Verdalune’s original software, design, mark, artwork and content belong to DataNaat or its licensors.
6. Software license and stores
Where an app store’s standard end-user license governs the software, that license applies. Otherwise, subject to these Terms and applicable store rules, DataNaat grants you a limited, personal, non-exclusive, non-transferable and revocable license to use Verdalune on devices you own or control for lawful gardening purposes. External components retain their own licenses.
7. Ending use and account deletion
You may stop using Verdalune at any time. Request account deletion at info@datanaat.com. We will verify the request and confirm the outcome. Once completed, deletion removes or de-identifies linked information from active Verdalune systems, subject to legal retention, protected backups and the limits on already licensed identification photographs described above. Deletion does not cancel a subscription; manage it in the store.
8. Responsibility, disputes and changes
To the maximum extent permitted by applicable law, Verdalune is supplied as available and DataNaat is not liable for indirect or consequential loss, including lost plants or crops. Nothing here excludes liability or consumer rights that cannot legally be excluded. You remain responsible for decisions involving food, chemicals, irrigation, electricity, structures, people, animals and property.
These same Terms apply globally. Nothing limits rights or remedies that the law applicable to you does not permit us to exclude. Before filing a claim, contact info@datanaat.com so we can try to resolve it. If that fails, either party may use courts or dispute-resolution procedures available under applicable law. You may also contact a competent authority where applicable law permits.
We may update these Terms when the service or legal requirements change. The current version and effective date will appear here, with additional notice when required. If a provision is invalid, the rest remains effective. A lawful business transfer may transfer these Terms while respecting applicable privacy and consumer rights.
